Minnesota Lawmakers Pushing for More Consistent Hemp Laws

By Editorial Team

April 5, 2021

Minnesota wants a little understanding and consistency – when it comes to hemp, that is. A group of four lawmakers from the state doesn’t like the current laws as they stand. They want these rules streamlined to take all the guesswork out of the landscape. The group believes that with more defined guidelines, consumers, growers, and the public will have a better understanding of the plant, its legal status, and how to navigate the burgeoning world of hemp.

Group of Four

Democratic legislators Sen. Tina Smith and Reps. Betty McCollum, Collin Peterson, and Angie Craig wrote several federal agencies. These include the FDA, OMB, USDA, and DEA. The group wrote in part that the agencies need to take more time to work together and layout federal guidelines “that will benefit farmers rather than punish farmers for factors that are out of their control.”

Contradictory Rules

According to the lawmakers, each agency has different rules that often seem to be at odds. One lawmaker went so far as to say that the “contradictory federal guidelines are leading to uncertainty in the market.” They also believe that a lack of direction is causing farmers to not achieve full economic potential. In turn, the group says that growers have planted less hemp since last year, which costs the state needed money.

More Stability Needed

The letter also reads that “a more stable market for hemp farmers” will ease investors’ concerns. The lawmakers take issue with the fact that the USDA can revoke a farmer’s license if a crop’s THC level is above 0.5%. The Minnesota four wrote that the rules are “burdensome.” Congress members from other states aren’t too fond of this law, either. In part, this led to a continuing resolution that Congress approved to provide more flexibility in the world of hemp.
